ARTICLE 2 – SUBJECT MATTER

The subject of this Agreement is to determine the rights and obligations between the Seller and the Buyer regarding the sale and delivery of the product or service ordered electronically by the Buyer through ecommercedu.com. In addition, the Buyer’s right of withdrawal, delivery procedures and other legal rights under the Law No. 6502 on Consumer Protection are specified here.

ARTICLE 3 – PRODUCT/SERVICE

The type, quantity, brand/model, color and price of the product or service have been determined as training packages and approved by the Buyer. The Seller shall deliver the product or service to the Buyer’s specified delivery address on the dates specified.

ARTICLE 4 – GENERAL PROVISIONS

4.1. The Buyer acknowledges that he/she is informed about the basic specifications, sale price, payment type and delivery information on E Commerce Edu and confirms the purchase electronically.

4.2. The Product will be delivered to the Buyer to the specified delivery address within the specified period (within the statutory 30 days). The delivery fee shall be paid by the Buyer.

4.3. If the Product is to be delivered to a person or organization other than the Buyer, the Seller is not responsible for non-acceptance of delivery.

4.4. The Seller is responsible for delivering the product safely, in accordance with the specifications specified in the order, complete and intact.

4.5. The price of the Product shall be paid by the type of payment chosen by the Buyer. If payment is not made, the Seller shall be deemed released from the obligation to deliver.

ARTICLE 5 – RIGHT OF WITHDRAWAL

The Buyer may exercise the right of withdrawal within 7 days from the delivery of the product. To exercise the right of withdrawal, the Buyer must notify the Seller in writing info@ecommercedu.com and return the product. Once the product has been returned, payment will be refunded to the Buyer within 10 days.

ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal is not applicable for the following products:

  • Products prepared in line with the buyer’s special requests,
  • Unpacked software and computer programs,
  • Perishable or expired products.

ARTICLE 7 – GENERAL PROVISIONS

7.1. Persons under the age of 18, persons with mental disabilities or legal disabilities may not make any purchase with the Seller.

7.2. The Seller cannot be held responsible for incorrect pricing due to systemic errors.

ARTICLE 8 – COMPETENT COURT

In disputes that may arise from this contract, the Consumer Arbitration Committees or Consumer Courts in the place of residence of the Buyer or the Seller shall be authorized.

This contract has been read, accepted and approved electronically by the Buyer. This Agreement is subject to the provisions of the Law No. 6502 on Consumer Protection and other relevant legislation.

MADDE 2 – KONU

İşbu Sözleşme’nin konusu, ürün satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun kapsamında Taraflar’ın hak ve yükümlülüklerinin belirlenmesidir. Ürün fiyatı ve özellikleri aşağıda belirtilmiş olup, Alıcı, Satıcı’ya ait internet sitesi olan ecommercedu.com’ dan elektronik ortamda sipariş vermiştir. Satıcı, Alıcı ve Sağlayıcı’nın hak ve yükümlülükleri ile cayma hakkı, bilgilendirme yükümlülüğü, teslimat usulleri ve diğer uygulamalar ilgili yönetmeliğe göre belirlenmiştir.

ARTICLE 3 – PRODUCT OF THE AGREEMENT

ARTICLE 4 – GENERAL PROVISIONS

4.1 The Buyer acknowledges that they have read the pre-information and other relevant details on the Seller’s website (ecommercedu.com), including basic features, sale price, price validity period, payment type, and delivery terms. The Buyer confirms the electronic purchase of the product.

4.2 The product will be delivered to the Buyer’s address or a designated person/institution within the specified time frame and no later than 30 days from the Seller’s receipt of the order. The shipment fee is paid by the Buyer. For e-books, the product will be sent to the Buyer’s indicated email address.

4.3 The Seller will not be responsible if the delivery is refused by the recipient at the designated address.

4.4 The Seller is responsible for delivering the product as ordered, safely and completely, in accordance with the qualities described in the order, and with the user manual and warranty certificate if applicable.

4.5 The product will only be delivered after the pre-information Agreement is confirmed electronically and the Buyer has paid for the product. If the price is not paid, or it is deleted from the bank records, the Seller is not obliged to deliver the product.

4.6 If the Buyer receives the product but payment is not made due to unauthorized use of the credit card, the Buyer must return the product within 3 days at their own expense.

4.7 If the Buyer pays by credit card and the cardholder is not the Buyer, the Buyer assumes all legal risks related to any disputes or unauthorized use of the card.

4.8 If the payment is made via ATM or bank deposit, the Buyer must send the correct IBAN number for any potential returns. Failure to provide this number means the Buyer cannot request a refund.

4.9 In case of force majeure (e.g., weather conditions, transport interruption), the Seller must inform the Buyer and the Buyer can opt to cancel the order, request a replacement, or delay the delivery.

4.10 For defective or damaged products, the Buyer can send the product back to the Seller for repair under warranty, with the Seller covering the shipping costs.

4.11 If the Buyer is outside Turkey, they are responsible for any customs duties and fees. If the Buyer’s address is outside the Seller’s courier service area, they may need to cover additional delivery costs.

4.12 The correspondence addresses given in this Agreement are valid for all notifications.

4.13 The Seller can communicate with the Buyer through the provided contact information, including via email, phone, SMS, or other means.

4.14 The Buyer agrees to comply with applicable laws when using the Seller’s website and acknowledges responsibility for any legal violations.

4.15 The Buyer shall not misuse the website, engage in illegal activities, or disturb other users.

4.16 Links to third-party websites may be provided by the Seller but do not constitute an endorsement or guarantee of their content.

4.17 The Buyer is liable for legal and punitive consequences if they breach any terms of this Agreement, and the Seller reserves the right to claim damages.

ARTICLE 5 – RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw within 7 days following delivery of the product, provided the product is unused, unopened, and in its original condition. The Buyer must notify the Seller in writing (via email, fax, etc.) within this time frame. A copy of the cargo delivery record and the original invoice should be returned. Refunds will be processed within 10 days, excluding shipping fees for returns.

ARTICLE 6 – PRODUCTS NOT SUBJECT TO RIGHT OF WITHDRAWAL

Certain products, including those prepared specifically for the Buyer or products that cannot be returned due to their nature (e.g., software, e-books, consumables), are exempt from the right of withdrawal.

ARTICLE 7 – GENERAL PROVISIONS

7.1 Individuals under 18, those with legal disabilities, or those lacking mental capacity may not make purchases from the Seller.

7.2 The Seller is not responsible for pricing errors due to system malfunctions or other issues.

ARTICLE 8 – COMPETENCE

In case of disputes, the competent jurisdiction is the Arbitration Committee for Consumer Problems or the Consumer Courts located at the Buyer’s residence or place of purchase, as per Turkish law.

This Agreement is read, accepted, and confirmed electronically. For matters not covered, the Code Regarding the Protection of Consumers numbered 6502 and applicable laws will apply.
